1. Scope of Services

Labs & Health of Miami LLC (“Company”) provides mobile phlebotomy and specimen collection services for patients, clinics, laboratories, and healthcare providers.

We are not a diagnostic laboratory, not a medical practice, and do not interpret, diagnose, or treat any medical condition.

All laboratory testing, processing, and results are handled exclusively by certified third-party laboratories selected by the client or ordering provider.

2. Appointments

Services are available by appointment only.

Appointment times are approximate and may vary due to traffic, geographic location, patient volume, or unforeseen operational factors.

Standard service fees include travel within our primary service area (Parrish, Bradenton, Lakewood Ranch, Palmetto, and Ellenton). Additional travel fees may apply for locations outside this area.

Additional fees may apply for:

After-hours visits

Weekend appointments

Holiday scheduling

Extended travel or rural-area visits

Specialized specimen preparation

Temperature-controlled transport

Same-day appointments are subject to availability and confirmation by the Company and are not guaranteed until approved.

Additional fees may apply if laboratory protocol requires specialized specimen preparation, including serum or plasma separation, transfer to secondary containers, or temperature-controlled transport.

We reserve the right to reschedule or cancel appointments due to weather conditions, safety concerns, or operational limitations.

3. Payment Terms

Payment is due at the time of booking or at the time of service unless otherwise agreed in writing.

Accepted payment methods include secure digital and card-based transactions processed through third-party providers.

Once a phlebotomist has been dispatched, the service fee and any travel charges become non-refundable.

Same-day and priority services are non-refundable once confirmed and scheduled.

Refunds apply only if a specimen collection cannot be completed due to a verified Company error.

4. Service Limitations

You acknowledge and agree that:

We provide specimen collection only.

We do not analyze, interpret, modify, or influence laboratory test results.

Specimen handling follows laboratory protocol; however, final processing, analysis, and reporting are solely the responsibility of the receiving laboratory.

The Company is not liable for laboratory delays, rejected samples, courier issues, or errors caused by third-party entities.

5. Client Responsibilities

Clients agree to:

Provide accurate and complete personal and medical information

Present a valid laboratory order when required

Follow all pre-collection instructions (e.g., fasting, hydration, medication guidance)

Maintain a safe and sanitary environment during in-home visits

Failure to comply with preparation instructions may compromise specimen integrity or result in denial of service.

6. Safety & Conduct

We reserve the right to refuse or discontinue service if:

The environment is unsafe or unsanitary

The client exhibits aggressive, abusive, or threatening behavior

Required documentation, consent, or identification is not provided

In such cases, any dispatch or travel fee remains non-refundable.

7. Liability Disclaimer

By using our services, you acknowledge and agree that Labs & Health of Miami LLC, its owners, employees, contractors, and affiliates:

Are not responsible for minor complications associated with venipuncture (including bruising, discomfort, or localized reactions)

Are not liable for laboratory testing errors, processing delays, or courier handling issues

Are not liable for incidental, indirect, special, or consequential damages

The Company’s maximum liability shall not exceed the amount paid for the specific service provided.

8. Medical Disclaimer

All services are non-diagnostic and limited strictly to specimen collection.

We do not provide medical evaluation, diagnosis, treatment, or medical advice.

All medical concerns must be directed to a licensed healthcare provider.

9. Privacy & Data Protection

All patient information is handled in accordance with our Privacy Policy and applicable HIPAA standards.

Online booking forms are used strictly for scheduling purposes. Clients are advised not to submit sensitive medical information, diagnostic details, or complete medical histories through website booking forms.

Laboratory ordering, patient data entry, and test result management are conducted through certified third-party laboratory platforms, including but not limited to Rupa Health and Ulta Lab Tests, which operate under HIPAA-compliant systems. Protected Health Information (PHI) is collected and processed exclusively within those secure platforms.

By booking a service, you consent to secure electronic communications (including phone, text message, and email) for scheduling, confirmation, and follow-up purposes.

10. Indemnification

You agree to indemnify and hold harmless Labs & Health of Miami LLC and its affiliates from any claims, damages, losses, or expenses arising from:

Misuse of our services or website

Inaccurate or incomplete information provided by you

Failure to comply with these Terms and Conditions

11. Governing Law

These Terms are governed by the laws of the State of Florida.

Any disputes arising from these Terms or services provided shall be resolved in the courts located in Manatee County, Florida, without regard to conflict-of-law principles.

12. Updates to Terms

We may update these Terms periodically.

Revised versions will be posted on our website with a new “Last Updated” date.

Continued use of our services constitutes acceptance of any updated Terms.
